TERMS OF SALE
Please read these terms of sale carefully. You will be asked to expressly agree to these terms of sale before you place an order for products from our website. In these terms of sale, “we” means JG Global Ltd T/A jollygoods. (and “us” and “our” will be construed accordingly); and “you” means our customer or potential customer for products (and “your” will be construed accordingly).
(3) Order process
The advertising of products on our website constitutes an “invitation to treat”; and your order for products constitutes a contractual offer. No contract will come into force between you and us unless and until we accept your order in accordance with the procedure detailed below. In order to enter into a contract to purchase products from us, you will need to take the following steps: (i) you must add any of the products you wish to purchase to your shopping cart, and then proceed to the checkout; (ii) if you are a new customer, you may have to create an account with us and log in; if you are an existing customer, you may be asked to enter your login details; (iii) once you are logged in, you may be asked to select your preferred method of delivery and confirm your order and your consent to these terms of sale; (iv) you will be transferred to the Stripe Payment website, and Stripe will handle your payment; (v) we will then send you an initial acknowledgement; and (vi) once we have checked whether we are able to meet your order, we will either send you an order confirmation (at which point your order will become a binding contract) or we will confirm by email that we are unable to meet your order.”
We will not file a copy of these terms of sale specifically in relation to your order. We may update the version of these terms of sale on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you download, print and retain a copy of these terms of sale for your records.
The only language in which we provide these terms of sale is English.
Before you place your order, you will have the opportunity of identifying whether you have made any input errors. You may correct those input errors before placing your order.
(4) Price and payment
Prices for products are quoted on our website. The website contains a large number of products and it is always possible that some of the prices on the website may be incorrect. We will verify prices as part of our sale procedures so that a product’s correct price will be stated when you pay for the product.
In addition to the price of the products, you may have to pay a delivery charge, which will be as stated when you pay for the product. Payment must be made upon the submission of your order. We may withhold the products and/or cancel the contract between us if the price is not received from you in full in cleared funds. The prices on the website include all value added taxes (where applicable). Payment for all products must be made by Debit or Credit Card and any other method detailed on the website from time to time. Prices for products are liable to change at any time, but changes will not affect contracts which have come into force.
(5) Shipping Policy
Non-Holiday Shipping Time ~ Most orders received by 2:00 pm will ship within 2 days provided the confections are in stock. As all of our products are sensitive to weather conditions and to ensure the quality of your confections, we will not ship packages over the weekend: these packages will be held until the following Monday. This is to avoid products being stored in a non-climate controlled shipping facility over the weekend. Once your order has been dispatched we are unable to cancel it or request postal address changes or recall it. Due to the fresh nature of our chocolates we do not accept orders back (or provide refunds).
All product that leaves our climate controlled premises is inspected and verified to be in perfect condition when we send it off. But despite our best efforts, we have no control over the temperatures during the delivery of your order and cannot accept responsibility for any chocolate that has been heat damaged and are unable to issue refunds or replace products damaged by extreme temperatures.
Remember chocolate is very sensitive to warm temperatures. You can help us to ensure that your product arrives in good condition by arranging delivery to an air conditioned location where somebody will be around to receive your package and let it have relief from the heat.
We use Royal Mail International Standard (formerly Airmail) for shipping our products. Delivery to a destination in Europe can take on average 3 to 5 working days and the Rest of the World 5 to 10 working days. UK weekends and Bank Holidays are not classed as working days.
Because we use a third-party delivery service, these times are estimates only and not guarantees. They are also subject to any matter beyond our reasonable control. International Standard Airmail is the cheapest option but carries NO INSURANCE whatsoever. Please note that JG Global Ltd T/A jollygoods.co will not and cannot be held liable for any losses, costs, damages or expenses incurred by the customer for any failure to meet an estimated delivery date. We cannot be held responsible for any delays in your order being delivered by your local Postal Service.
We offer no refund/compensation of delivery charges should your order not arrive on the estimated delivery time/day as this is totally beyond our control. This includes delays caused by adverse weather conditions.
For an extra charge you can elect to have your parcel shipped via the following Royal Mail Postal Services:
Royal Mail International Tracked & Signed: This service receives priority handling in the UK and overseas. And provides full end-to-end tracking, plus signature on delivery and online confirmation.
International Tracked (formerly Airsure): This service offers full end-to-end tracking with online confirmation.
International Signed For: This service provides tracking until the point the item leaves the UK. And requires a signature before delivery can take place. Royal Mail Tracked And Signed and Royal Mail International Tracked require a signature on delivery, if no one is in to sign for the order they will be taken back to your local postal depot.
Why is shipping so expensive?
We are one of the few on line companies that does not use shipping as a ‘profit centre’ but it is important to remember that shipping is based on weight and distance and that chocolate/candy tends to be both bulky and heavy.
International orders may take longer to arrive due to customs delays etc, and we will not be held responsible in any way for any delays and subsequent issues with the sell by dates/product condition. We do not offer refunds for the late arrival of chocolates. Please note that we cannot be held responsible for any additional taxes or duty/import charges that may be charged to a recipient of a parcel for overseas customers. If you are unsure if you are likely to be charged we recommend that you contact your countries customs service before placing your order.
Due to Custom requirements, the value of the contents are displayed on the customs shipping note on the outside of the box within the Customs information. No invoice details are placed inside the box. Customs do require that the value of the contents are displayed on the shipping information on the outside of the box. Regardless of which shipping method you choose, JG Global Ltd T/A jollygoods.co does not provide refunds for melted products.
Please keep in mind the following:
1. The type of product you are purchasing
2.The current weather and future (7 day weather trends) in your area.
3. Where possible try to have your item shipped to a commercial address: often times the carriers deliver earlier in the day to commercial addresses and there is often air conditioning or shaded areas to keep your order cooler.
4. If you must have a package shipped to a location where no one will be available to receive it (at home when everyone is at work etc.), please leave a note for the carrier to leave the package in an area where you know will remain shady for the majority of the day.
We will happily exchange or refund money where the product is defective or not of merchantable quality, subject to the exclusion under ‘shipping terms’ above. If you are in any way dissatisfied with our products or service we will always do our best to ensure that we resolve the problem to your satisfaction. Once your order has been dispatched we will only consider claims for refunds for damaged goods, as our products cannot be resold, due to the freshness of the products. In general we do not accept returns of perishable items.
The purchaser is bound to inspect the condition of the packaging of the goods upon delivery.
In the event that an order is received and there is a discrepancy as to a missing item, a claim must be submitted within one week, (7 days) of physical receipt. In the event that a product is received in unusable condition, for reasons other than extremes of temperature, a claim must be submitted within one week (7 days) after physical receipt of merchandise.
Please note that we do our best to pack your order in such a way that damage should not occur in transit. In the event that your item has been damaged we will do our best to remedy the situation, however certain items are a high risk item and cannot be changed/refunded due to damage in transit by an external courier company/postal service over which we have no control. ** Should your item arrive damaged or there is an issue with an item you have received, please do not dispose of the item before contacting us as we may require photographic evidence in order for us to investigate further**
8. What if your order has not arrived:
The vast majority of items are delivered on time, but from time to time some items may go missing or be delayed. Royal Mail will not deem a parcel to be lost until it has been in the postal system for a period of 15 days (UK) and 20 working days for International orders. Although it is highly unlikely deliveries will take this amount of time. Please check that your local post office is not holding it for collection.
* PLEASE NOTE THAT WE CANNOT PLACE ANY CLAIM FOR LOSS OF A PARCEL UNTIL 15 WORKING DAYS HAVE PASSED SINCE THE DISPATCH OF YOUR ORDER. WE APPRECIATE THAT THIS IS NOT ALWAYS CONVENIENT HOWEVER THIS IS ROYAL MAIL POLICY AND NOT SOMETHING THAT CAN BE CHANGED BY US*
We will do our utmost to make sure that we resolve your issue so long as we are contacted within a reasonable amount of time. We will not accept any claims outside of 28 days from the date of dispatch as after this time we are not able to make any claims from the postal agents.

You warrant to us that:
(a) you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms of sale;
(b) the information provided in your order is accurate and complete; and
(c) you will be able to accept delivery of the products.
(10) Risk and ownership
The products will be at your risk from the time of delivery. Ownership of the products will only pass to you upon the later of:
(a) delivery of the products; and
(b) receipt by us of full payment of all sums due in respect of the products (including delivery charges).
Until ownership of the products has passed to you, you will possess the products as our fiduciary agent and bailee, and if you are a business customer you must store the products separately from other goods and ensure that the products are clearly identifiable as belonging to us. We will be entitled to recover payment for the products even where ownership has not passed to you.
(11) FORCE MAJEURE
In this Section and Section 11 below, “force majeure event” means :
(a) any event which is beyond our reasonable control;
(b) the unavailability of raw materials, components or products, and/or
(c) power failure, industrial dispute affecting any third party, governmental regulations, fire, floods, disasters, civil riots, terrorist attacks or wars. Where a force majeure event gives rise to a failure or delay in us performing our obligations under these terms of sale, those obligations will be suspended for the duration of the force majeure event.
Statutory Rights Nothing in these terms of sale affects any statutory rights you may have as a consumer.
